Later, Dan would venture into the commercial litigation realm, representing large companies in a variety of litigated and transactional matters.  Returning again to the insurance industry, Dan joined the Nationwide Insurance Trial Division and represented Nationwide, Scottsdale, Allied, and National Casualty insureds in varying general liability and transportation defense cases.  While with Nationwide Trial Division, he handled wrongful death actions, slip-and-falls, construction defect cases, products liability matters, and standard auto accident defense.  Dan successfully brought a number of those matters to conclusion at trials before juries of up to eight (8) panelists.

Dan has also handled many aspects of complex commercial litigation matters in the health care field at the State and Federal level.  Additionally, Dan participated at Medical Board hearings and in criminal court defending claims brought on behalf of, or against, medical doctors in the course of their practice. 

More recently, Dan has focused his practice on plaintiff’s personal injury lawsuits with particular emphasis on medical and dental malpractice actions, commercial and business matters (both litigation and transactional), employment suits, and Federal and State False Claims Act/Whistleblower cases.  Dan also represents clients in local municipal courts for DWI, traffic violations, simple assault, drug possession and neighbor disputes.  He handles more serious criminal defense matters and domestic violence cases, as well. Dan Marchese is Certified by the Supreme Court of New Jersey as a Civil Trial Attorney.  He has extensive civil litigation experience at the Federal and State level, having devoted more than a substantial portion of his professional time toward the preparation and trial and all matters litigated.  Dan has appeared for trial in all twenty-one (21) of New Jersey’s County Superior Courts.

Dan grew up and lived to adulthood in West Orange (Essex County).  A 1989 graduate of The Pingry School in Martinsville, New Jersey, Dan was graduated from Georgetown University in 1993, with a Bachelor of Arts in Government and a Minor in Psychology.  Most notably, as a Hoya, Dan was Georgetown’s official mascot, “Jack the Bulldog” from 1990 to 1993.  

Dan obtained his Juris Doctor degree from the Seton Hall University School of Law in 1997, where he served as a Member and Book Review Editor of the Seton Hall Law Review.  Additionally, he was the research assistant to Professor E. Judson Jennings, helping him to pen the Jennings and Weissenberger New Jersey Evidence Courtroom Manual; this manual is still widely used by litigators across the State.

Enjoying admission to practice in New Jersey, Dan may also appear before the United States District Court for the District of New Jersey.  He is a member of the Sussex County, New Jersey State, and American Bar Associations.
Dan began his legal career “in the trenches” from the start.  Sworn in by the Honorable Carol Ferentz, J.S.C. (retired) first thing in the early morning on the day he was licensed, he made his second appearance “on the record” at a deposition later on in the afternoon.

As a young attorney, Dan primarily served as defense counsel to large insurance company’s insureds, handling primarily auto accidents and premises liability matters.  At that time, his work also brought him to the municipal level, as he represented Abercrombie & Fitch privately prosecuting shoplifters in their Menlo Park Mall location.

Dan tried his first jury trial before the anniversary of his first year in the practice.
